This introductory chapter first describes the approach used in the present book, which offers empirical evidence on medical malpractice in the United States. It then discusses medical malpractice and tort law; the indicators of a broken system; the four markets—legal, medical malpractice insurance, medical care, and government activity—where medical malpractice outcomes are determined; and the five myths of medical malpractice. An overview of the subsequent chapters is also presented.
